These Terms of Service (“Terms”) govern your access to and use of Volterra (mineralvolatility.com), including its website, data feeds, risk scores, forecasts, and related materials (together, the “Service”). By accessing the Service, requesting access, or using any data we provide, you agree to be bound by these Terms and by our Disclaimer, which is incorporated by reference. If you do not agree, do not use the Service.
Volterra is a publisher of general, impersonal, statistical information. The Service delivers the same data set to all subscribers and is not tailored to any individual's objectives, financial situation, or needs. The Service is not, and must not be used or construed as, financial product advice, investment advice, investment research, a personal recommendation, or an offer or solicitation to buy, sell, or hold any security, derivative, or commodity. No adviser–client, fiduciary, or agency relationship is created by your use of the Service.
The Service is intended for professional, business, and institutional users (such as traders, risk managers, procurement teams, and analysts) who have the knowledge and experience to evaluate statistical risk information independently. By using the Service you represent that you are using it in a professional or business capacity and not as a retail consumer seeking personal financial advice.
Subject to these Terms and payment of any applicable fees, Volterra grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the data internally within your organisation. You may not resell, redistribute, sublicense, publish, or otherwise make the data available to any third party, nor use it to create a competing product, without Volterra's prior written consent.
All intellectual property rights in the Service — including the models, scores, software, compilations, and content — are owned by Volterra or its licensors. These Terms grant you a licence to use the data, not any ownership interest.
The Service incorporates third-party data, including news and event data from the GDELT Project and exchange price data referencing venues such as the LME, COMEX, NYMEX, and SGX. Such data is provided subject to the rights and terms of the relevant third parties. Volterra makes no representation that you are licensed to use any third-party data other than as delivered within the Service, and you are responsible for any independent licensing your use may require.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including any implied warranty of accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose. Risk scores and forecasts are probabilistic statistical estimates and may be incorrect. Volterra does not warrant that the Service will be uninterrupted or error-free.
Any performance figures, case studies, or examples are hypothetical and based on historical backtesting. Hypothetical and backtested results have inherent limitations, are not a record of actual trading, and are not indicative of future results. Individual examples are illustrative only, are not representative of all outcomes, and do not imply that the model detects every event.
To the maximum extent permitted by law, Volterra and its operators, officers, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading or investment losses, lost profits, or lost opportunity, arising from or related to your use of or reliance on the Service. To the maximum extent permitted by law, Volterra's total aggregate liability arising out of or relating to the Service shall not exceed the total fees you paid to Volterra in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You are solely responsible for your own investment, trading, hedging, and procurement decisions and for any outcomes. You agree to indemnify and hold harmless Volterra and its operators from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
Volterra may suspend or terminate your access to the Service at any time, with or without cause. Provisions that by their nature should survive termination — including intellectual property, no warranty, limitation of liability, indemnification, and governing law — survive.
Volterra may modify the Service or these Terms from time to time. Material changes will be reflected by updating the date below. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia, without regard to conflict-of-laws rules. You submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia. Nothing in these Terms limits any non-excludable rights you may have under the Australian Consumer Law.
